Per 1 april 2024 beëindigt de Stichting Spaarnestad Photo haar activiteiten.

In 2010 begon de samenwerking tussen de Stichting Spaarnestad Photo te Haarlem - beter bekend onder de naam Spaarnestad Photo - en het Nationaal Archief in Den Haag. Daarmee werd de fotocollectie Spaarnestad behouden en voor de toekomst veiliggesteld.
In 2024 staat een grote wijziging voor de deur. Via deze weg willen wij u op de hoogte brengen van het feit dat Stichting Spaarnestad Photo per 1 april 2024 haar activiteiten zal staken.
Het bestuur ziet zich hiertoe genoodzaakt door een aantal ontwikkelingen die de bestaanszekerheid van de stichting hebben aangetast/ondermijnd. Die ontwikkelingen zijn van technische, economische en juridische aard. In grote lijnen komt het erop neer dat door verdergaande digitalisering veel beeldmateriaal van instellingen nu vrij toegankelijk is op velerlei media sites. De vraag naar bemiddeling, research en tussenkomst van de stichting is navenant afgenomen. Verder is er een economische teruggang in de uitgeverijwereld waardoor langlopende contracten wegvallen en opdrachten uitblijven.
Voor de Stichting Spaarnestad Photo betekent dit alles een zodanige terugval in eigen inkomsten dat voortzetting op basis van het bestaande bedrijfsmodel niet meer verantwoord is.
Wat betekent dit voor u?
De Stichting Spaarnestad Photo zal per 1 april 2024 niet langer aanspreekpunt zijn voor u als auteursrechthebbende, afdrachthouder, bruikleengever of gebruiker. De belangrijkste verandering voor u is echter dat Stichting Spaarnestad Photo haar activiteiten rondom de commerciële exploitatie van de beeldrechten op foto's zal staken.
Het Nationaal Archief zal voortaan het loket zijn voor vragen naar / over foto's uit de collecties. Het contactpunt in deze is info@nationaalarchief.nl.
Wat niet veranderd is, is dat op grond van de Auteurswet het Nationaal Archief bij gebruik van foto's waarop auteursrechten van derden rusten, eerst toestemming van de auteursrechthebbende zal vragen (tenzij dit gebruik zonder toestemming is toegestaan op grond van de Archiefwet en andere wettelijke regelingen).
Afdrachthouders van wie zich materiaal in de fotocollecties van het Nationaal Archief bevindt, raden wij aan contact op te nemen met Pictoright (https://pictoright.nl). Pictoright is een organisatie die visuele makers zoals fotografen helpt om aanspraak te maken op de collectieve vergoedingen waar zij recht op hebben. Daarnaast kunnen zij Pictoright opdracht geven om hun rechten te beschermen en vergoedingen te innen voor het gebruik van hun werk.

In 2010 the collaboration between the Stichting Spaarnestad Photo in Haarlem - better known as Spaarnestad Photo - and the Dutch National Archives in The Hague began. In this way, the Spaarnestad photo collection was preserved and secured for the future.
A major change is imminent in 2024. We would like to inform you that the Spaarnestad Photo Foundation will cease its activities as of April 1, 2024. The board is forced to do so by a number of developments that have affected/undermined the foundation's economic possibilities. These developments are both of a technical, economic and legal nature. Broadly speaking, this means that due to further digitization, a lot of images from institutions are now freely accessible on many media sites. The demand for mediation, research and mediation by the foundation has decreased accordingly. Furthermore, there is an economic downturn in the publishing world, which means that long-term contracts are no longer available and orders are not forthcoming.
For the Spaarnestad Photo Foundation, all this means such a drop in its own income that it is no longer justifiable to continue on the basis of the existing business model.
What does this mean to you?
As of April 1, 2024, the Spaarnestad Photo Foundation will no longer be a point of contact for you as a copyright holder, remittance holder, lender or user. The most important change for you, however, is that the Spaarnestad Photo Foundation will cease its activities surrounding the commercial exploitation of the image rights to photos.
From now on, the National Archives will be the point of contact for questions about photos in the collections. The contact point in this case is info@nationaalarchief.nl.
What has not changed is that, under the Copyright Act, the Dutch National Archives will first request permission from the copyright holder when using photos subject to third-party copyright (unless this use without permission is permitted under the Archives Act and other legal regulations).
We recommend that remittance holders whose material is in the photo collections of the Dutch National Archives contact Pictoright (https://pictoright.nl). Pictoright is an organization that helps visual creators such as photographers to claim the collective compensation to which they are entitled. In addition, they can instruct Pictoright to protect their rights and collect fees for the use of their work.
